1. General overview

1.1. 2Men2Van LTD offer man and van service providers across the United Kingdom access to reservation system to have their quotes appear live on-line for customers to book instantly as subcontractors.
1.2. All our subcontractors wishing to use 2Men2Van LTD service acknowledge having read and agreed to the following Terms and Conditions.
1.3. Nothing in these Terms and Conditions shall limit or exclude our liability to you for death or personal injury caused by our negligence or fraudulent misrepresentation or any other liability that may not, under the English law, be limited or excluded. Subject to this, in no event shall we be liable to you for any business losses, damages, or injuries sustained during any removal related task, any liability we do have for losses you suffer is strictly limited to losses that were reasonably foreseeable.
1.4. The term "2Men2Van Limited", "2Men2Van LTD", "us" or "we" refers to the owner of the website whose address is. The term "subcontractor, "service provider", “man and van driver” or "you" refers to companies receiving confirmed bookings from 2Men2Van LTD on-line reservation platform.
1.5. As a condition to using our on-line reservation platform you must register your contact details to obtain a user's account with us. Take care to make sure that these details are accurate and true and are kept up-to-date for as long as you are an active subcontractor on our system.
1.6. We have the right to change any username or identification password, whether chosen by you or allocated by us, at any time, if in our opinion that user name is identifiable by customers independent of the 2Men2Van LTD platform enabling said customers to book the service provider directly.
1.7. You will be asked to agree to these Terms and Conditions before you can complete the subcontractor sign-up process.
1.8. We may update our Terms and Conditions at any time without notice and you agree that you will comply with said Terms and Conditions or remove yourself from the 2Men2Van LTD reservation platform within 7 days of the update.
1.9. Please note that Service providers are subject to sections on Customer Terms and Conditions and all subcontractors must read that as well.
1.10. We recommend you take note of the intellectual property rights section. Please also note as part of our privacy policy and non-disclosure policy that subcontractors agree upon joining that no third-party reviews will be made about the company for a period of 1 year if the subcontractor decides to leave or is removed from the system.
1.11. 2Men2van LTD reserves the right to terminate this agreement with immediate effect and without the requirement to provide the man and van driver with a reason.
1.12. Users must be at least 21 years of age to register with us.



2. Intellectual Property Rights

2.1. We are the owner or the licensee of all intellectual property right in our website and in the material published on it. Copyright laws are in force and all such rights are reserved.
2.2. You must not use any part of any material on our website for commercial purposes without obtaining a license to do so from us.
2.3. You may print off one copy and may download extract of any pages from our site for your personal reference, but you must not modify the paper or digital copies you have printed off or downloaded any way.
2.4. You shall not acquire or use the words “2Men2Van” or any variant that includes the words “2Men2Van” as a trademark or any related intellectual property.



3. Jurisdiction

3.1. The jurisdiction of the English courts shall apply in exclusivity over any claim arising from, or related to, a visit our website. We also retain the rights to bring proceedings against you for breach of these Terms and Conditions in your country of residence or any other relevant country.
3.2. These Terms and Conditions and any dispute or claim arising out of, or in connection with them, shall be governed by and construed with the law of England and Wales.



4. Calls Recording

Calls may be recorded for training and quality purposes, and we reserve the right to use these records in the unfortunate event that a dispute arises.



5. What we do

5.1. We aim to provide a pier-to-pier sharing platform where the customers and businesses which provide transport services can find each other.
5.2. 2Men2Van LTD may provide transport services directly, on that occasion accounts are clearly marked by using our company name.
5.3. It is up to you to select the service provider based on the service you require.
5.4. Please note that about any transaction made between you and client, the resulting legal contract is between you both and not between 2Men2Van LTD.



6. Responsibilities of the subcontractor

6.1. It is the subcontractor responsibility to complete every booking scheduled by 2Men2Van LTD professionally as per our standards and to completion to the satisfaction of the customer.
6.2. It is also the responsibility of the subcontractor to ensure that they are physically fit enough to complete the booking before beginning.
6.3. The subcontractor is responsible for all of his team members present on the booking scheduled by 2Men2Van LTD.
6.4. The subcontractor is responsible for the collection of funds owned at the conclusion of the booking and payment relevant taxes associated to the service providing for the client.
6.5. The subcontractor hereby stating that by ticking the box on the sing up form page, by clicking the activation link and agree with the entire content of agreement and confirming that all data provided are true.



7. Obligatory equipment

The subcontractors are obligated to carry on their vehicles at all the times a minimum of the following:
• One box trolley
• Six cargo straps (attested)
• Five Bungee courts (attested)
• Basic tools (screwdriver with the bits, allen keys, spanner keys)
• Ten blankets
Failure to attend bookings without these items will result in the subcontractor account being suspended and reviewed. Also, we may charge any funds to cover replacement cost and customer compensation.



8. Commission

8.1. The 2Men2Van LTD charging 30% commission from the quote. This commission is covered by the deposit which client paying during the booking process.
8.2. We are reserving the right to change the commission percentage at any time.



9. Payments

9.1. There are two methods of payment for the booking. 9.1.a. Deposit prepaid and remaining balance by cash directly to the subcontractor after the job done.
9.1.b. Fully prepaid booking- the customer paying whole amount for the booking, then 2Men2Van LTD will transfer your fee into the bank account provided during the reservation process.
9.2. All payment for incidentals (such as additional time and other not included within the booking) the customer must pay directly to the subcontractor.
9.3. It is the subcontractor responsibility to collect the direct payments from the customer.
9.4. The payments for prepaid bookings are made on weekly basis and proceed every Thursday after the period end.
9.5. As proof of the payment the 2Men2Van LTD will send a statement to the email address provided on the registration.
9.6. The funds will be transferred into the bank account provided on the registration.



10. Receipts

10.1. For any payments directly to you, you must provide receipt or invoice for the client.
10.2. For all deposit payments and pre-paid bookings, we are providing receipts with the booking confirmation sent via email to the customer.



11. Tolls

Tolls are not included within the booking rate. In the event of crossing the area with the tolls, you need to collect the payment from the client.



12. Confirmed bookings

12.1. 2Men2Van LTD will accept confirmed bookings within the geographical postcode areas chosen by the man and van subcontractor when signing up.
12.2. If the subcontractor will not accept a confirmed booking which is then relocated, but still attend and arrives before the new service provider, the original subcontractor can be debited any funds owed to him used to cover organised replacement.
12.3. If the subcontractor fails to update the schedule inside in the calendar section of his account and if any booking will drop-in which he cannot attend, the subcontractor can be debited any funds owed to him to organise replacement and compensation for the client.
12.4. If the subcontractor does not accept the confirmed booking which is then relocated, but still attends and arrives at the loading address after new service provider, the original subcontractor will be not compensated.
12.5. If the subcontractor receives a new booking, then does not answer his phone, the subcontractor can be debited any funds for the replacement cost and client compensation.
12.6. If the subcontractor receives a new booking, then he turns his phone off, the subcontractor can be debited any funds for the replacement cost and client compensation.
12.7. Whenever 2Men2Van LTD send a confirmed booking to the subcontractor. The subcontractor agrees to accept the booking via reservation platform within the time from the notification sent by text message and email.

12.7.a. For bookings scheduled on the next day or longer: 10 hours.


12.7.b. For booking scheduled on the same day: 1 hour.


12.8. If the subcontractor accepts the booking, automatically accepts the responsibility for that booking is expects to complete it in full.
12.9. From the subcontractors may be expected to make multi drop journey for the customer. On that situation the subcontractor is allowed to charge for additional stop- the fee must be agreed with the customer before and that is not excluding charging for additional time half hourly rate as per amount settled on pricing section.
12.10. The subcontractors are not permitted to “part load” bookings or complete multi-drops during a customer's booking. Customers will expect to be able to use the entirety of the van loading area for their booking and for the driver to travel from loading to unloading address directly. If a subcontractor is found to be 'part loading' bookings, we are reserving the right to debt any funds to compensation for the client.



13. Online quotes

The subcontractors may choose when they want their quotes to be shown live on our website through the calendar section in their account. They are responsible for updating that section accordingly as per their availability.



14. Cancelations

The subcontractors can cancel their account at any time in writing to: info@2men2van.co.uk . Cancelation and pause requests will be processed and actioned within one working day from the date of receiving the request.



15. Updating schedule

If you cancel a booking due the not updated schedule on your account, we will charge GBP 15.00 cancelation fee, also you may be debited any funds for organise a replacement and customer compensation.



16. Delay/Lateness

16.1. In case of delay/lateness you must contact customer in as soon as possible before arranged arrival time and keep him updated in regards of estimated time of arrival. If the delay is more than 30 minutes 2Men2Van LTD team must be notified as well.
16.2. If case if the current job taking longer than expected, which means that you will be late on the next booking, you must contact customer as soon as possible before arranged arrival time. If the delay is more than 30 minutes 2Men2Van LTD team must be notified as well.
16.3. Failure to make contact in regards of the points wrote above will result in the subcontractor account being suspended and reviewed.



17. Booking cover

In case if you cannot cover a booking which you have scheduled on calendar you must contact 2Men2Van LTD team immediately. Failure to contact, may result of account suspension and reviewed.



18. Contact details

18.1. The subcontractor acknowledges that by confirming their email address during the registration process, they confirm this is a valid email address for all future confirmed bookings.
18.2. Subcontractors can correct any input errors entered when signing up by going to the profile section of their account.
18.3. lt is the subcontractor responsibility to inform 2Men2Van LTD of any changes to their contact details, including their email address, you can inform us of any changes to your contact details by emailing: info@2men2van.co.uk.



19. Privacy

2Men2Van LTD will not share your personal contact information with any third party. More information on our privacy policy can be found in the cookies section of the homepage. Please note that we reserve the right to use your National lnsurance Number to make the required driving licence checks with the DVLA.



20. Passwords

Once you have registered with our system and have set your password do not give this information to anyone else or allow anyone else to use it. Unless you contact 2Men2Van LTD and inform us of suspected unauthorized use of your account, all account activity will be treated as if it were carried out by you.



21. Deactivation

21.1. We may deactivate an account at any time if we suspect you have not complied with these Terms and Conditions; in the event of abusive of threatening behaviour or if we think the security of the 2Men2Van LTD website is at risk.
21.2. In the event that the subcontractor is deactivated, the subcontractor accepts that any documents or profile that has been created on the website is the sole ownership of 2Men2Van LTD.



22. Breaches

On the situation that you breach or are suspected of breaching these Terms and Conditions we will take the following disciplinary steps:
22.1. Suspend your account and hold the funds owed to you until the outcome of the investigation is complete.
22.2. Assing letter of concern
22.3. Assign the warning
22.4. Assing the final warning
22.5. Commission level change
22.6. Temporary block your account
22.7. Permanently block your account
22.8. Add to the persona non-grata list
22.9. Delete and/or edit of all of your user account content



23. Non-Attendance

23.1. If you cannot attend to the booking, you must notify 2Men2Van LTD team minimum two hours before the booking is due to start. We may charge any funds for replacement arrangements and compensation for the customer.
23.2. If the subcontractor fails to attend an accepted booking the subcontractor can be debited any funds for replacement arrangements and compensation for the customer.
23.3. If a customer is not present at the loading address, no person nominated by the customer is present and the customer is not contactable. The subcontractor must contact immediately with 2Men2Van LTD team.
23.4. If a customer is not present at the loading address, no person nominated by the customer is present and the customer is not contactable by the subcontractor or by 2Men2Van LTD, the subcontractor will wait for 50% of the booked time from the designated time of the booking if the booking has been paid in full. If a deposit amount only has been paid, or if the booking is an 'all cash' booking, the driver will wait for 60 minutes from the designated time of the booking.
23.5. No refund will be made if the subcontractor has attended as booked and waited for the requisite period on time before leaving the booking.
23.6. If the subcontractor attends a booking and the customer is not present, no person nominated by the customer is present and the customer is not contactable by the subcontractor or by 2Men2Van LTD the subcontractor must take pictures of the loading address to evidence attendance and submit on our email (info@2men2van.co.uk). In the event of a subsequent dispute, the subcontractor will rely on his photographic evidence to prove his attendance at the booking.
23.7. In the event that a booking does not take place and is not completed in full, the subcontractor will receive a cancellation fee for his attendance. Full payment cannot be made in a situation where a booking has not taken place.
23.8. The Consumer Contracts (lnformation, Cancellation and Additional Charges) Regulations 2013 are not applicable to service Contracts which provide for the transport of goods on a specific date or period for performance.



24. Punctually

24.1. If the subcontractor accepts the booking is expected that he will arrive on time.
24.2. The subcontractor always must contact client as soon as possible before original arrival time to inform about the delay. Also, the subcontractor must keep the client updated about estimated time of arrival.
24.3. The subcontractor must report any lateness more than 30minutes to 2Men2Van LTD team.
24.4. In case if client is unable to wait, the subcontractor must report that fact immediately 2Men2Van LTD team.
24.5. If the subcontractor will be late more than one hour, we may charge any funds for the compensation for the client as partial refund as per list below.
24.5.a. 1-1.5 hour late: 5% refund
24.5.b. 1.5- 2 hours late: 10% refund
24.5.c. 2-3 hours late: 15% refund
24.5.d. Next day reschedule: 35% refund
24.6. In the event if the customer cannot wait due the lateness, we may charge you any funds for replacement arrangements and customer compensation.
24.7. Lateness policy does not apply for last minute bookings.



25. Vehicle break downs

25.1. If the event if your vehicle is broken down and you cannot attend, you must contact 2Men2Van LTD immediately.
25.2. If your van is breaks down on the way to the client, you must contact 2Men2Van LTD team immediately and send us visual proof of the breakdown and receipt of the repair.
25.3. If your van is breaks down with the customer, you must contact 2Men2Van LTD immediately. You suppose organise on your own cost replacement and reloading. We will require visual proof or breakage and receipt of the repair.
25.4. We may debt any funds for replacement and compensation for the customer.
25.5. Failure of the brake down reporting may result suspension of account and reviewing.



26. Rejections/Non-acceptance of bookings

26.1. If the subcontractor does not accept or reject a booking within the set time limit the subcontractor can be debited any funds for the replacement arrangements or customer compensation.
26.2. If the subcontractor accepts a live job offer and then rejects it again, the subcontractor can be debited any funds for the replacement arrangements or customer compensation.
26.3. If the subcontractor attends a booking without obligatory equipment, the subcontractor can be debited any funds for the replacement arrangements or customer compensation.



27. Helpers

27.1. The subcontractor is full responsible for all of his team members sent to the booking.
27.2. If the subcontractor attends with incorrect quantity of people required on the booking, the subcontractor can be debited any funds for replacement arrangements and/or customer compensation.
27.3. If the subcontractor attends with extra people than required, he cannot charge extra customer. On the event on that situation, the subcontractor can be debited any funds for replacement arrangements and/or customer compensation. Also, the subcontractor account may be suspended and reviewed.



28. Vehicle size

28.1. If the subcontractor attends with smaller vehicle than client booked, the subcontractor can be debited any funds for replacement arrangements and/or customer compensation.
28.2. The subcontractor is allowed to arrive bigger vehicle then client booked, however on the event of that situation, the subcontractor must contact customer before to make sure that vehicle will fit into loading/unloading area. Also, the subcontractor cannot charge the client extra for that facility.



29. Overbooking

It is subcontractor responsibility to make sure that all accepted bookings of 2Men2Van LTD are covered on time. If the subcontractor takes more jobs than his capacity, the subcontractor can be debited any funds for replacement arrangements and/or customer compensation. Also, if that situation will repeat constantly, the subcontractor account can be suspended and reviewed.



30. Account cancelations

If the subcontractor account is cancelled, then the subcontractor signs up under the false pretences, once detected than fact, we are reserving the right to decline account activation. In the event of detecting that fact after activation, we are reserving the right block the account immediately and keep any funds owned to the subcontractor.



31. Insurance

If the subcontractor refuses to give a customer their Goods in Transit or Public Liability details within 5 working days after the booking. 2Men2Van LTD retains the right to provide those details directly to the customer and debt any funds to customer compensation.



32. Overcharging

If the subcontractor is found to have overcharged a customer, the subcontractor the subcontractor can be debited any funds for customer compensation. Also, if that situation will repeat constantly, the subcontractor account can be suspended and reviewed.



33. Loss of keys

If the subcontractor loses his van keys before or while on the booking, the subcontractor can be debited any funds for replacement arrangements or/and customer compensation.



34. Conduct

34.1. 2Men2Van LTD expects from the subcontractors to always conduct themselves in a professional manner.
34.2. If the subcontractor or any helpers attend a property and do not conduct themselves in a professional manner and engage in a heated altercation with the customer, the subcontractor debited any funds for replacement arrangements or/and customer compensation. We also retain to right to suspend account and hold the owned funds until internal investigation and court cases are completed.



35. Court action

If the subcontractor threatens 2Men2Van LTD with court action, we retain the right to suspend his account and retain any monies owed to the driver until the court case is complete.



36. Complaints

36.1. When a complaint is made regarding damaged customer goods, we retain the right to hold any funds owned to the subcontractor and suspend the account until the claim is settled. If the subcontractor does not resolve the complaint to 2Men2Van LTD or the customer's satisfaction, we retain the right to settle the claim from any monies owed to the subcontractor who will incur an administration fee for our time spent resolving this issue when the subcontractor is deemed to be at fault.
36.2. If the customer complaint is under investigation or the subcontractor account is suspended, we retain the right to hold any monies owed to the subcontractor until the outcome of the investigation is complete.
36.3. We will inform the subcontractor via email of any complaint submitted by a customer. We allow 5 working days from that initial email for the subcontractor to respond to the complaint. If no response is received from the driver, we will send a second chasing email. In the event of further nonresponse from the subcontractor, after 5 working days of him being notified of the complaint, the complaint will be resolved by 2Men2Van LTD on behalf of the subcontractor.
36.4. Any complaint under investigation will be considered void if the customer fails to respond to correspondence from us for a period more than 28 days.
36.5. In the event of a dispute between customer and subcontractor proceeding to Court, the subcontractor remains solely liable for all Court costs in relation to any claim, or counterclaim, issued by the customer as a result of that dispute.
36.6. In the event of a dispute between customer and service provider proceeding to Court, 2Men2Van LTD reserve the right to levy a non-ńxed administration fee for their time spent dealing with any aspect of those legal proceedings.
